What Is At-Will Employment and Why It Matters

When it comes to employment in the United States, most workers are employed "at-will"—a term that’s simple in concept but important to understand clearly.

What Does At-Will Employment Mean?
At-will employment means that either the employer or the employee can end the working relationship at any time, for any reason—or for no reason at all. This can be done with or without prior notice. It gives both parties flexibility and freedom when it comes to making employment decisions.
However, at-will employment does not mean that employers can fire employees for illegal reasons. Terminations based on discrimination (such as race, gender, age, or religion), retaliation, or other violations of employee rights are still strictly prohibited by law.
Is At-Will Employment the Standard Everywhere? Yes—every U.S. state except Montana assumes that employment is at-will by default, unless a written agreement states otherwise. Employment contracts, union agreements, or specific company policies may modify or override the at-will assumption.
Why Is It Important to Put It in Writing? If you want to maintain an at-will relationship with your employees, it’s critical to make that clear in your documentation. The best place to do this is in your employee handbook. Including a simple, well-worded at-will employment statement can help protect your business and reduce confusion down the line.
